ADEQ Proposes Using UST RF to Pay for WQARF Clean Ups

APMA met with ADEQ earlier this month to discuss legislative priorities for UST reforms in the 2019 session.

At that meeting, ADEQ shared their new proposal to fund the Water Quality Assurance Revolving Fund (WQARF) with $11,000,000 per year from the UST Revolving Fund, in exchange for an indefinite continuation of the UST penny per gallon fee and incorporating the UST program into the agency’s sunset review. Their proposal was submitted to the Governor’s office before it was presented to APMA and communicated to the WQARF stakeholder community the day after it was presented to APMA.

Aside from the WQARF funding issue, APMA is working with ADEQ on other UST issues including reforms to the lien statute to allow pre-settlement before the work is conducted and making the Tank Site Improvement Program (TSIP) funding cap equivalent to state lead non-corrective action program.
