UST Testing Deadline & Enforcement Discretion

October 13, 2018 is the deadline for the remaining UST requirements in the 2015 federal regulations and it is only eight weeks away. Learn more about the new requirements here.

In late July, the US EPA denied the request for a three-year UST inspection and testing requirement compliance deadline extension. However, EPA has agreed to delay its enforcement in the event there is a shortage of contractors or equipment. EPA said that enforcement discretion would be given to those tank owners showing a “good faith effort” to comply by the October 13, 2018 deadline. Evidence of a good faith effort would be having a contract for compliance work in place by October 13.

Since Arizona does not have state program approval, the October 13, 2018 deadline stands, subject to the enforcement discretion described above. States with program approval have the ability to set a later compliance date.
