AG Letter on Hemp & Legislative Session Update
Last week, Attorney General Mayes sent out this letter regarding enforcement against stores selling THC products without a marijuana license. Please note that if your stores sell any edibles or beverages that contain THC, even if derived from hemp, that starting April 24, 2025, the Attorney General’s Office plans to take enforcement action. SB1556, a bill legalizing and regulating hemp beverages, was scheduled to be heard in the House Appropriations Committee this week but was removed from the agenda. Without a hearing, it will be dead in its current version.
Today is the 80th day of the Arizona Legislative session and we are NOT on pace to have a budget deal and adjournment by day 100. Below you can find updates on APMA priority bills:
• HB2300 Striker (fuel formulations) – This is a late-introduced near-repeat of last year’s fuel formulations bill. APMA Board voted to OPPOSE the bill. It passed the Senate Natural Resources Committee 4-3 (party line), awaiting action by full Senate then returns for vote of the full House. Senate Committee amendment linked here.
• HB2166 (diesel tax stickers) – Passed House 40-18 (bipartisan), passed Senate Public Safety Committee 5-1 (bipartisan), awaiting action by full Senate. House engrossed version linked here.
• SB1730 (UST reforms) – Passed Senate 24-1 (bipartisan), passed House Natural Resources, Energy and Water Committee 9-0, awaiting action by full House. Senate engrossed version available here.
• HB2629 (swipe fee reform) – Failed to pass House floor and dead for this year.
• HB2165 (SNAP restriction on soda) – Passed House 32-27 (party line), passed Senate Health and Human Services Committee 4-3 (party line), awaiting action by full Senate. House engrossed version linked here. APMA opposes.
• SB1556 (hemp beverage regulation) – Passed Senate 23-6 (bipartisan) with floor amendment. Senate engrossed version available here.
• SB1272 & SB1603 Striker (vapor product registry) – Passed House Transportation Committee 5-1 (bipartisan) but not heard in House Appropriations.

The Senate Director Nominations Committee has held four hearings and recommended approval of 5 out of 6 nominees. The Department of Agriculture nominee Paul Brierly and the Department of Environmental Quality nominee Karen Peters have not yet been scheduled for a hearing yet.
