WMSD Announces Vapor Compliance Inspections

Last week, the Weights and Measures Services Division sent a letter to the regulated community about upcoming unannounced fuel retailer inspections using the CARB pressure decay test to ensure compliance with state statutes and rules on vapor containment. Testing is underway starting this week.

Attorney General Sends Vapor Products Letter

Arizona Attorney General Kris Mayes sent a letter to tobacco distributors in the state in April regarding the need to sell only lawful products in Arizona. It’s our understanding that the letter is intended for education rather than enforcement purposes, though it seems to put distributors/retailers on notice with the incomplete FDA database as the standard. APMA is working with our tobacco partners on how best to respond.

FDA’s enforcement via monetary penalties is ongoing and still seems to be targeting the following brands: Elf Bar, Esco Bar, Flum Gio, Lost Mary, Puff Bar and related offshoots. FDA Warning letters are going out for a much longer list of brands. More information is available on their website here.
